1. Introduction

Welcome to PGAK Innovation Pvt. Ltd. (“we”, “our”, “us”).
These Terms and Conditions (“Terms”) govern your access and use of our website https://pgak.co.in, mobile application, and software products (collectively, the “Service”).

These Terms apply to:

  • Customers – individuals or businesses who use our AI-powered software.
  • Dealers/Partners – individuals or companies authorized by PGAK Innovation Pvt. Ltd. to sell or distribute our software to end users.

By accessing, registering, or using our Service in any capacity (as a customer or dealer), you agree to these Terms.
If you do not agree, please do not use our Service.

2. Eligibility & Account Responsibility

  • You must be 18 years or older to register as a Customer or Dealer.
  • You agree to provide accurate and complete information during registration.
  • You are responsible for maintaining the confidentiality of your account credentials and for all actions under your account.
  • PGAK Innovation Pvt. Ltd. reserves the right to suspend or terminate your account if false information or misuse is detected.

3. Dealers / Partner Program

  • Dealers are authorized resellers who promote, sell, and activate PGAK software licenses for customers.
  • Dealers earn a commission or profit margin from each customer purchase, as agreed upon in the dealer agreement or dashboard.
  • Dealers are not employees or legal representatives of PGAK Innovation Pvt. Ltd. — they act as independent partners.
  • Dealers must not misrepresent the brand, pricing, or features of PGAK software.
  • PGAK reserves the right to modify commission rates or terms with prior notice.
  • Any fraudulent activity, misuse of customer data, or violation of brand ethics can result in immediate termination of dealership and legal action.

4. Use of Service (for Customers)

  • Customers are granted a non-transferable, non-exclusive license to use PGAK software for surveillance and security purposes.
  • Customers must use the Service only for lawful purposes.
  • Any attempt to reverse-engineer, copy, or resell the software without authorization is prohibited.
  • PGAK may suspend accounts in case of non-payment, misuse, or system abuse.

5. Payments, Pricing & Commission

  • All payments for software subscriptions, renewals, or features are non-refundable, as stated in our Refund Policy.
  • Dealers receive commissions or discounts as per agreed terms visible on the Dealer Dashboard or via email confirmation.
  • PGAK reserves the right to adjust pricing, features, or commission structures at any time with notice.
  • Failure to pay or fraudulently claiming commissions may result in account suspension or legal action.

6. Data & Privacy

  • PGAK respects your privacy. Please review our Privacy Policy to understand how we handle your data.
  • The AI system analyzes video feeds only for security-related purposes and does not share data with third parties without consent.
  • Dealers must also comply with privacy laws and not misuse customer information collected during software sales or activation.
  • Customers and Dealers are responsible for ensuring that their use of the Service complies with local data protection and surveillance regulations.

7. Third-Party Integrations

  • Our software may connect with third-party CCTV brands, hardware, or cloud platforms.
  • PGAK is not responsible for any malfunction, data loss, or incompatibility caused by third-party integrations.

8. Intellectual Property

  • All software, logos, trademarks, and related materials are the intellectual property of PGAK Innovation Pvt. Ltd.
  • Dealers and customers may use our branding only as permitted — unauthorized use is strictly prohibited.
  • Any attempt to clone, modify, or distribute our software or brand identity will invite legal consequences.

9. Limitation of Liability

  • PGAK Innovation Pvt. Ltd. shall not be liable for any direct, indirect, incidental, or consequential losses arising from the use or inability to use our software or platform.
  • We do not guarantee uninterrupted or error-free operation, though we strive for high reliability and uptime.

10. Termination of Account

  • PGAK reserves the right to suspend or terminate accounts (Dealer or Customer) in case of violation of these Terms, non-payment, or misuse of the software.
  • Upon termination, your access to the Service will cease immediately, and any unpaid dues or withheld commissions will be subject to review.

11. Modifications to These Terms

We may modify or update these Terms at any time.
Any changes will be reflected on this page with an updated “Last Modified” date.
Continued use of the Service after updates means you agree to the new Terms.
